Terms of Service

1. Acceptance of Terms

By accessing or using WebCraft services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with these terms, you must not use our services.

2. Service Description

WebCraft provides Website-as-a-Service (WaaS), which includes custom website design, development, managed cloud hosting, ongoing maintenance, security monitoring, and content updates as defined by your chosen subscription plan.

3. Website Ownership & Licensing

The website designed and developed by WebCraft is licensed, not owned, by the Client until 36 consecutive monthly payments have been made in full. Upon completion of 36 payments, full ownership rights, including source code, design assets, and domain configuration, will be transferred to the Client. During the licensing period, WebCraft retains all intellectual property rights to the website design and code.

4. Payment Terms

Payments are processed through Razorpay and may be made via UPI AutoPay, credit/debit card, or bank mandate. Setup fees (where applicable) are due before project commencement. Monthly subscriptions are billed on the same date each month and auto-renew unless cancelled. All prices are listed in Indian Rupees (₹) and are exclusive of applicable taxes.

5. Payment Failures & Grace Period

In the event of a failed payment via UPI AutoPay, credit card, or bank mandate, WebCraft will provide a 7-day grace period. The website will remain fully operational during this grace period. If the outstanding payment is not resolved within 7 calendar days, the website will be temporarily suspended. Service will be restored within 24 hours of payment resolution. WebCraft reserves the right to terminate the agreement after 30 days of non-payment.

6. Monthly Updates Scope

Each subscription plan includes a defined number of update hours per month (1 hour for Standard, 2 hours for Growth). "Updates" are defined as: text modifications, image replacements, menu changes, contact information updates, minor styling adjustments, and content additions to existing pages. The following are NOT included in monthly updates and will be quoted separately: new page creation, structural redesigns, e-commerce functionality, custom feature development, third-party integrations, and database modifications. Unused update hours do not roll over to subsequent months.

7. Cancellation Policy

Either party may terminate the agreement with 30 days written notice. For the Zero Down Plan, early termination within the 12-month commitment period will incur a fee equal to 3 months of the monthly subscription cost. After the commitment period ends, cancellation is free of charge. Upon cancellation, WebCraft will provide a final backup of all website files and content.

8. Hosting & Uptime

WebCraft provides managed cloud hosting with a 99.9% uptime Service Level Agreement (SLA). Scheduled maintenance windows will be communicated at least 48 hours in advance and will be performed during off-peak hours when possible. In the event of unplanned downtime exceeding 0.1% in a calendar month, affected clients will receive a pro-rated service credit.

9. Client Responsibilities

The Client agrees to: provide all necessary content (text, images, logos) in a timely manner; respond to communications within 5 business days; maintain active domain registration and DNS access; ensure all content provided does not infringe on third-party intellectual property rights; and keep payment methods current and valid.

10. Limitation of Liability

WebCraft's total liability for any claims arising from or related to these services shall not exceed the total fees paid by the Client in the 12 months preceding the claim. WebCraft shall not be liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost data.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.
